Press Release: People in Son La sent a letter requesting police office to investigate Son La Rubber Joint Stock Company

According to the Document 12873/VPCP-V.I of Government Office on 01/12/2017, 67 households  in Cu Pe and Un Hamlet, Muong Bon Commune, Son La province asked police officers  to investigate some people of Son La Rubber Joint Stock Company who have signs of violating the legal regulation

On 21/12/2007, People's Committee of Son La Province affirmed the Decision 30/2007/QĐ- UBND which was about the policy of rubber tree development in Son La province from 2007 to 2011. In 2008, people were forced to contribute their agricultural lands to Son La Rubber Joint Stock Company in order to plant rubber trees. Vietnam Rubber Group is mainly responsible for implementing and managing Son La Rubber Joint Stock Company in carrying out this project. Besides, in the process of implementing the rubber tree development policy from 2008, people have found out some illegal actions.

Offences against regulations on the management and the using  public capital that lead to serious consequences (Article 220 Criminal Code of Vietnam 2015)

The first one is about the problem of single support: in 2008, depending on the resolution 180/2007/NQ- HDND on 10/12/2007 "the policy of rubber tree development in Son La province", people received the support cost when they replaced the other plants with rubber trees. However, they haven't received any support cost for their contribution.

The second one is about the publication of information and documents related to land contribution. People haven't kept any documents and received any information about their rights and obligation related to land contribution. The information is about the stock, shareholder list, articles of association, the reports and the resolution of the annual general meeting.

Offences against regulations on land use (Article 228 Criminal Code of Vietnam 2015)

According to the Decision 990/QD- TTg, the land contribution to plant rubber trees violates the legal regulation. The Company is responsible for giving the allowance for people in case it doesn't have dividends. However, people haven't received any allowance since they contributed their lands. In addition, people haven't kept joint capital contracts.

Besides, some rights related to land contribution aren't guaranteed. For 10 years, people didn't have income from planting rubber trees. Meanwhile, if a household has 2 ha that plants corn and jicama, it can earn 600 million VND. If they plant cane, they can earn 120 million VND per year and 1,2 billion VND in 10 years. All people in Mai Son District can earn 600 billion VND in 10 years. Therefore, people asked police office to investigate some people of  Son La Rubber Joint Stock Company.
